This Privacy Policy explains how Athlete Audience, trading as Trackside Partners (a business name registered in Australia) ("we", "us", "our"), collects, uses, stores, and shares information when you visit athleteaudience.com, use the Athlete Audience portal, complete a fan audience survey hosted by us, or otherwise engage with our services.

By using our website, submitting a form, or providing information to us in any way, you confirm that you have read and understood this Policy.

01 — Who We Are and How to Contact Us

Athlete Audience is operated under the registered business name Trackside Partners (Australia). We are the data controller for personal information collected through our website, portal, and surveys.

We aim to respond to verified requests within the timeframes required by the law applicable to you. Where the law permits, we may take up to the maximum allowed period to respond.

02 — Information We Collect

We handle three distinct kinds of information, and it matters that they are kept separate:

  • Fan survey responses — anonymous. When you complete a survey associated with an athlete, we collect your answers, the channel you arrived from (for example "instagram"), and the date. We do not collect your name, email, IP address, or any free-text that identifies you as part of the survey, and we cannot link your answers back to you. These responses are anonymous and are not personal information.
  • Optional prize-draw entry — personal information. If, after completing a survey, you choose to enter a prize draw, we collect the name and email you provide and any optional message. You must confirm you are 18 or over. This information is stored separately from survey answers and is not linked to them.
  • Athlete and account holders. If you are a participating athlete or account holder, we collect identity and contact details (name, email, region), onboarding information (your audience and channel data and the professional details relevant to the service), account and authentication data, and our communications with you.

We also collect limited technical data for the website and portal (device, browser, pages visited, timestamps). For spam prevention on the survey we derive a one-way hashed value from your IP address, held briefly in a separate store and not linked to survey answers or used to identify you. See Section 06 for cookies.

You are not required to provide personal information to us, but some features of our services cannot be offered without it.

03 — How We Use Your Information

We use personal information for purposes that include, but are not limited to:

  • Delivering, operating, securing, and improving the Athlete Audience service and its associated deliverables.
  • Building, operating, and improving our website, portal, surveys, and related tools.
  • Producing aggregated and anonymised audience intelligence, analytics, insights, reports, and case studies — including for use in our own marketing, sales materials, and commercial decision-making.
  • Communicating with you about our services, including responses to enquiries, programme updates, and operational messages.
  • Sending you marketing communications where you have provided the necessary consent or where we are otherwise permitted to do so under applicable law. You may opt out of marketing at any time.
  • Maintaining records, meeting legal and regulatory obligations, and protecting our legal rights.
  • Detecting, investigating, and preventing fraud, abuse, security incidents, and breaches of our terms.

Where permitted by applicable law, we may use information you provide to us — including survey responses and onboarding information — to develop, train, and refine internal models, benchmarks, and methodologies, on an aggregated or de-identified basis.

04 — Legal Bases for Processing

Where the EU General Data Protection Regulation or the UK GDPR applies, we rely on one or more of the following legal bases:

  • Consent — where you have given us specific, informed consent, for example to receive marketing or to participate in a survey.
  • Contract — where processing is necessary to perform a contract with you or to take steps at your request before entering into a contract.
  • Legitimate interests — including operating, improving, securing, and marketing our services; producing aggregated insights from data we hold; defending our legal position; and pursuing the commercial interests of our business. We have considered the impact on you and believe these interests are not overridden by your rights and freedoms.
  • Legal obligation — where processing is required to comply with a legal or regulatory obligation.

You may ask us at any time for further information about the legal basis on which any particular processing activity is carried out.

05 — Sharing Your Information

We do not sell your personal information for monetary consideration.

We may share personal information with the following categories of recipients:

  • Service providers and processors who help us operate our business, including hosting, database, authentication, email delivery, survey, analytics, and payment providers.
  • Participating athletes, where you have submitted information through a survey or interest form associated with that athlete — but only in the manner described to you at the point of collection, and where appropriate in aggregated or limited form.
  • Professional advisers, including lawyers, accountants, auditors, and insurers.
  • Successors in the event of a sale, merger, acquisition, restructuring, or transfer of all or part of our business or assets.
  • Regulators, courts, law enforcement, or other authorities where we are required or permitted by law to do so.

Aggregated, de-identified, or anonymised data — which cannot reasonably be used to identify you — may be shared without restriction, including with commercial partners, prospective sponsors, and the wider public.

06 — Cookies and Tracking Technologies

Our website and portal use cookies and similar technologies to operate properly, remember your preferences, measure performance, and understand how visitors use the site. Some cookies are strictly necessary; others are used for analytics or to support our marketing. The public fan survey sets no cookies.

07 — International Data Transfers

We are a global business and our service providers operate in multiple countries. As a result, your personal information may be transferred to, stored in, and processed in countries other than the country in which it was collected, including countries that may not provide the same level of data protection as your home country.

Where required by applicable law, we put in place appropriate safeguards for international transfers, including Standard Contractual Clauses, the UK International Data Transfer Agreement or Addendum, or other lawful transfer mechanisms. You may contact us for more information about the safeguards in place for any particular transfer.

08 — How Long We Keep Your Information

We retain personal information for as long as is reasonably necessary to fulfil the purposes set out in this Policy, including for the duration of our relationship with you, to defend or establish legal claims, to comply with our legal and regulatory obligations, and to maintain accurate records of our business activities.

Where we no longer need to retain information in identifiable form, we may anonymise it and continue to use the anonymised data indefinitely.

Prize-draw entries. If you enter an athlete's prize draw, your name, email address, and any suggestion you provide are shared with that athlete, who runs the draw and contacts the winner directly. If you tick the separate mailing-list box, the athlete may also add you to their own mailing list — that relationship is with the athlete, not Athlete Audience, and you can unsubscribe with them at any time. Athlete Audience does not contact prize-draw entrants and permanently deletes entries from its own systems 10 days after the athlete's survey closes. Anonymous survey responses contain no personal information and are unaffected.

09 — Security

We maintain technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration, and disclosure. No system, however, is perfectly secure, and we cannot guarantee the absolute security of information transmitted to or stored by us.

10 — Your Rights

Depending on where you live and the law that applies to you, you may have some or all of the following rights in relation to your personal information:

  • Access — the right to ask us for a copy of the personal information we hold about you.
  • Correction — the right to ask us to correct inaccurate or incomplete information.
  • Deletion — the right to ask us to delete personal information in certain circumstances.
  • Restriction or objection — the right to ask us to restrict or object to certain processing.
  • Portability — the right to receive certain information in a structured, machine-readable format.
  • Withdrawal of consent — where processing is based on consent, the right to withdraw that consent at any time, without affecting the lawfulness of prior processing.
  • Complaint — the right to lodge a complaint with a competent supervisory authority.

Specific country and regional rights:

  • EU and EEA residents — rights under the General Data Protection Regulation; the supervisory authority is the data protection authority of your country of residence.
  • UK residents — rights under the UK GDPR and the Data Protection Act 2018; the supervisory authority is the Information Commissioner's Office (ico.org.uk).
  • California residents — rights under the CCPA/CPRA, including the right to know, delete, correct, and limit the use of sensitive personal information, and the right not to receive discriminatory treatment for exercising your rights. We do not sell personal information for monetary consideration; certain disclosures to advertising and analytics providers may, however, be considered "sharing" under California law.
  • Australian residents — rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, including the right to complain to the Office of the Australian Information Commissioner (oaic.gov.au).

Because our fan survey responses are anonymous, these rights attach to the personal information we can link to you — participating athletes and prize-draw entrants. They cannot attach to anonymous survey answers, because we cannot identify which answers are yours.

To exercise any of these rights, contact us at privacy@athleteaudience.com. We may need to verify your identity before responding. Where the law permits us to charge a reasonable fee or refuse manifestly unfounded or excessive requests, we reserve the right to do so.

11 — Children

Our surveys are intended for respondents aged 18 and over. We require an 18+ confirmation before the survey and do not offer an under-18 option, and we do not knowingly collect information from anyone under 18. If you believe someone under 18 has provided information, contact us and we will take appropriate steps to delete it.

12 — Third-Party Sites and Services

Our website and communications may contain links to third-party sites, applications, and services that are not operated by us. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party services you use.

13 — Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. The updated Policy will be posted on our website with a revised "Last updated" date. Your continued use of our services following any change constitutes your acceptance of the updated Policy.
